What Is the COP3?
The COP3 is the official Assessment of Capacity form required by the Court of Protection in England and Wales. It must be completed by a registered medical practitioner who has personally assessed the individual, and it forms a critical and mandatory part of any Court of Protection application. Cherries Medical Clinic provides independent COP3 assessments carried out by our GMC-registered doctor. The COP3 form and any supporting report are prepared to the standard required by the Court of Protection Rules and the Mental Capacity Act 2005.
What Is the COP3 Used For?
The COP3 Assessment of Capacity form records the assessor’s professional opinion on whether the person lacks capacity in relation to the specific decision at issue. This could relate to property and financial affairs, health and welfare decisions, residence, or consent to medical treatment. The form requires the assessor to apply the two-stage test set out in the Mental Capacity Act 2005, which asks first whether the person has an impairment or disturbance of the mind or brain, and second whether that impairment means they are unable to make the specific decision in question — that is, whether they can understand relevant information, retain it, weigh it up, and communicate their decision.
When Is a COP3 Assessment Required?
A COP3 assessment is required in a range of Court of Protection situations. These include cases where a deputy or attorney is applying to manage someone’s property and financial affairs, where there is a dispute about whether a person has capacity to make a specific decision, where a Local Authority or NHS Trust is applying for a welfare order, where a family member is applying to become a deputy for a relative who lacks capacity, and where the Court of Protection requires independent medical evidence in contested proceedings. It is also required when an urgent or
interim Court of Protection order is being sought.
What the Assessment Covers
The assessment begins with a thorough review of all relevant medical history, records, and existing diagnoses. A structured cognitive and capacity assessment is then conducted using validated clinical tools appropriate to the individual’s presentation. The assessment is specifically focused on the decision or decisions referenced in the COP1 application and applies the two-stage Mental Capacity Act 2005 test. The official COP3 Assessment of Capacity form is completed in full. Where
required by the court or instructing solicitor, a supplementary medical report is also produced, providing fuller context and clinical reasoning. The assessment addresses all four elements of the functional test: whether the person can understand the information relevant to the decision, retain that information, use or weigh it as part of the decision-making process, and communicate their decision.

No. The COP3 is a capacity assessment, not a diagnostic report. Its purpose is to record a professional opinion on whether the individual lacks capacity in relation to the specific decision at issue. The assessor will note relevant diagnoses where these are known and relevant to the
capacity question, but the primary function of the COP3 is to address capacity, not to diagnose.
