Alcohol Failed Breathalyser Medicolegal Expert Witness Report
At Cherries Medical Clinic, we have completed thorough medicolegal expert witness reports following a review of patient medical records and physical examination of clients, who claim to have a legitimate medical or surgical condition that would explain their rationale for a failing a roadside or police station alcohol breathalyser following suspected drink driving or erratic driving patterns on the road.
We do receive cases from barristers who may have been ex-police officials or have an in-depth knowledge of the police system.
Equally, we would be happy to provide such medicolegal reports from individuals or other occupational sectors.
Our medicolegal reports are in accordance with the terms of the tribunal as such
CJ Act 1967, sect 9 MC Act 1980, ss5A (3) (a) and 5 B, Criminal Procedure Rules 2012, patl27.
You will be reviewed by Dr Anwar who is a Private GP, Occupational Health Physician and has a medicolegal background. The cases that he has done are mainly based on the defendant.
The appointment will usually last around 1 hour in duration and would involve a thorough review of the medical records, review of any police witness statements (if this is available) and then a thorough physical examination which would usually involve the following:-
Any relevant use of clinical screening tools or questionnaires to assess probability of any incidental diagnoses i.e. suspected sleep apnoea.
Again the list above is not exhaustive and each case will be taken on its own merit.
N.B. We do not provide any medicolegal forensic reports based on alcohol back level calculations and interpretation.
Our standard charge would be £500 for the completion of this report and we aim to provide rapid reports within 48 hours of the initial report.
